**NMG COMPUTERS Warranty Policy**

Effective Date: 12/12/2023

**1. New Products Warranty:**
All new products purchased from NMG COMPUTERS come with a minimum one-year warranty. This warranty covers any defects in materials or workmanship under normal use during the warranty period.

**2. Refurbished or Second-Hand Products Warranty:**
All refurbished or second-hand products sold by NMG COMPUTERS are covered by a one-year warranty unless specified otherwise at the time of purchase.

**3. Battery Warranty:**
For devices containing batteries (e.g., laptops), the batteries are covered by a six-month warranty. This warranty covers any defects in the battery’s performance under normal use during the specified period.

**4. Warranty Request Procedure:**
Customers must report any defects or issues covered by warranty on the date of discovery. Warranty requests should be made promptly to ensure timely resolution. The date of the warranty request must fall within the one-year anniversary from the original purchase date, regardless of when the issue occurred.

At a minimum reports should be made via phone call to 07 5559 5400 or an email to sales@nmgcomputers.com.au failure to do so at time of discovery may void the warranty terms.

**5. Tampering and Warranty Voidance:**
Any evidence of tampering, unauthorized repairs, or modifications to the product will void the warranty. Warranty coverage applies only to products in their original, unaltered state.

**6. Software Warranty Exclusion:**
NMG COMPUTERS does not cover software-related issues under the warranty. This includes, but is not limited to, operating system malfunctions, software conflicts, or data loss.

**7. Back to Base Warranty:**
All warranty claims are “back to base,” requiring customers to send the defective device to NMG COMPUTERS for assessment. After assessment, NMG COMPUTERS will either send the device to the manufacturer for repairs or, in the case of second-hand products, replace the device within the one-year anniversary from the original purchase date.

**8. Limitation of Liability:**
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE EXTENT PERMITTED BY LAW, NMG COMPUTERS IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO: LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF ACTUAL MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO OR CORRUPTION OF DATA; DOWNTIME; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH NMG COMPUTERS PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON NMG COMPUTERS PRODUCTS.

**9. Shipping Terms:**
Our warranty follows a Return to Base (RTB) policy. This means that customers are responsible for shipping the product to NMG COMPUTERS for assessment, and NMG COMPUTERS will cover the return shipping costs to the customer.

**10. Exclusions from Warranty Coverage:**
The NMG COMPUTERS warranty explicitly excludes coverage for the following:

– **Physical Damage:**
– Physical damage to the product, including damage to the motherboard pins (this includes bent pins).

– **External Sources:**
– Damage caused by external sources, such as power surges.

– **Software Configuration:**
– Damage resulting from incorrectly configured software, BIOS settings, or hardware drivers.

– **Malicious Software:**
– Problems caused by viruses or other malicious software.

– **Operating System Issues:**
– Operating system problems not caused by hardware failure.

– **Accidental Damage:**
– Accidental damage, including water spills, drops, or physical breakage due to accidents.

– **Data Loss:**
– Data loss or recovery due to drive damage or failure. However, the HDD or SSD is covered and will be replaced during the warranty period in the event of failure.

– **Cryptocurrency Mining:**
– Any ‘mining’ of electronic coins, including but not limited to Bitcoin, Ethereum, Doge Coin, will result in the voiding of the warranty.

– **Overclocking or Modification:**
– Any overclocking or modification performed by the customer or an external technician will void the warranty.

– **Product Condition:**
– The product must be in its original shipped condition and of the same configuration as purchased to be eligible for warranty coverage.
